Wage and hour violations can include failing to pay minimum wage, failing to pay overtime, refusing to permit breaks, misclassifying workers as exempt or as independent contractors, failing to pay a promised bonus, and forcing employees to complete work off the clock. California’s minimum wage is in flux, as are Los Angeles’ local requirements. In California, the minimum wage is gradually increasing based on the size of the employer. In 2018, the minimum wage is $10.50 for employers that have at least 25 employees and $11 for employers with 26 or more employees. However, in 2019, smaller employers will need to pay a minimum wage of $11, and larger employers will need to pay a minimum wage of $15. As of July 2017, the minimum wage that must be paid in the city of Los Angeles if your employer has at least 26 employees is $12/hr., and the minimum wage if your employer has 25 or fewer employees is $10.50/hr. The minimum wage as of that date for nonprofits with 26 or more employees and approval to pay a deferred rate was also $10.50. However, as of July 2018, the minimum wage that must be paid by larger employers is $13.25/hr., while the minimum wage for smaller employers and certain nonprofits is $12/hr. As of July 2019, the minimum wage for larger employers is $14.25/hr., and the minimum wage for smaller employers is $13.25/hr. These minimum wages will increase until July 2021, when they will be $15/hr. for employees of all employers.
Employment discrimination is forbidden in California under both state and federal laws. The Fair Employment and Housing Act (FEHA) is the state law under which you can bring a lawsuit if you are subjected to discrimination or harassed based on a protected characteristic. Protected characteristics include race, gender, disability, national origin, religious creed, and more.
Although the general rule is that employment is at will in California, you cannot be terminated for illegal reasons under state and federal laws that apply, including anti-discrimination laws like FEHA.
